The US Supreme Court has allowed the Trump administration to reinstate a policy that removes the X gender marker from all passports. In a six to three decision, the Court lifted an earlier order that had blocked the measure, granting the government permission to enforce it while the case continues.

In June, Judge Julia Kobick halted the policy, describing it as an unjustified classification based on sex.
The Department of Justice appealed, claiming that a passport’s sex marker is simply a factual entry comparable to a person’s place of birth, not a discriminatory act. The Supreme Court’s conservative majority agreed, ruling that recording sex at birth does not violate equal-protection principles.
Justice Ketanji Brown Jackson, writing for the dissenting judges, warned that the decision leaves transgender and nonbinary Americans facing an impossible choice. They must either carry identification that misrepresents their identity or avoid situations requiring a passport, such as travel, banking, or employment.
